- Divorce: In Indiana, divorce is called a dissolution of marriage and it is granted on a no-fault basis. We handle both non-contested divorces, where the parties agree on all or most of the divorce-related issues, as well as contested divorces.
- Property division: Indiana is an equitable distribution state, meaning that the court will divide your marital property assets in a way it deems fair to the parties, with the general presumption of a 50-50 split. Our attorneys will help you understand the factors the court considers in arriving at its decision.
- Spousal maintenance: Spousal maintenance, also known as alimony, is generally granted by agreement of the parties. Alimony may also be awarded at the court's discretion if it is proven that one party needs the other's support to become self-sustaining. If spousal maintenance is awarded, it does not usually exceed three years.
- Custody: Custody refers to both legal custody (decisions regarding a child's school, religion, health care, etc.) and physical custody (where the child spends most of their time). Although joint custody is common, the court ultimately makes its decision based on the child's best interests.
- Visitation: If parents are unable to come to agreement on a visitation schedule, the court will determine the schedule by applying Indiana parenting time guidelines.
- Child support: Child support is determined by applying a formula to various factors specified by the Indiana child support guidelines. We will help you understand those factors and give you a realistic assessment of what to expect.
- Paternity: At Newman & Newman, we assist clients in custody and support proceedings related to paternity determinations.
- Post-decree enforcement of support and custody orders: If the other party is not living up to his or her obligations with regard to support, child custody or visitation, we will help you seek judicial enforcement and sanctions if necessary.
- Post-decree modification of support and custody orders: If there has been a substantial change in life or financial circumstances, a modification to an existing support or custody order may be warranted. We represent parties seeking or defending against modifications.
- Adoption: We handle all necessary paperwork to put your domestic adoption into legal effect.
- Stepparent adoption: If one parent has remarried and the other biological parent is failing to meet their support or visitation obligations, a stepparent may seek to take over the role of the biological parent and adopt the child. At Newman & Newman, we work with stepparents to handle the termination of parental rights required to effectuate this.
- Protective orders: We have experience representing parties either seeking or defending against a protective order.
- Prenuptial and postnuptial agreements: We work with clients who are about to married or who have already married to establish an agreement addressing division of finances and assets if the marriage does not work out.
